Medeaz.com, it’s website, mobile application, sub-domains, it’s services are operated and owned by Medeaz Healthcare Systems – A unit of Ishaanyu Private Limited here referred to as “Medeaz or We or Us”, .
All users who visit, access, use the website, mobile applications, affiliates, and all sub-domains in any forms:
- PProvider Partner / Health Provider (Hospitals / Clinics / Diagnostics / Pharmacies / Wellness Centers / Fitness Centers / Clinicians / Physiotherapists / Nutritionists / Nurses / Paramedical / Any other support staff of provider partners) who are registered / published or to be published in Medeaz
- Healthseekers (Registered healthseeker and his/her family members / affiliates whomever authorized by healthseeker) who visits / access / desires to use Medeaz services through Medeaz and it’s affiliates.
- Corporates / Sponsors (Corporate companies / NGOs / Associations / Consultants etc.) who visits / access / desires to use/sponsor Medeaz services to their employees / associates / customers / partners etc. through Medeaz and it’s affiliates.
Hereunder referred to as “Users or You or Your”.
Please Read These Terms And Conditions Carefully Before Accessing Or Using This Medeaz Platform In Any Form.
If you are using medeaz, these terms are applicable and you agree to be bound by these terms and conditions of usage. if you do not agree to all of these terms, please do not use this platform.
1.Nature And Applicability Of Terms
This document is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries guidelines) 2011, that provides for the due diligence to be exercised for the access or usage of this Website.
Medeaz reserves the right at any time, at our sole discretion, to change or otherwise modify the Terms and Conditions without prior notice. You should read the Agreement at regular intervals. Your use of the Website following any such modification constitutes your agreement to follow and be bound by the Agreement so modified.
Medeaz is a platform which connects the healthseekers to the Provider Partner / Health Provider (Hospitals / Clinics / Diagnostics / Pharmacies / Wellness Centers / Fitness Centers / Clinicians / Physiotherapists / Nutritionists / Nurses / Paramedical / Any other support staff of provider partners) who are registered / published or to be published in Medeaz for any of their health needs (Doctor Appointments / Healthchecks / Telemedicine / Diagnostics / Medicines / Outpatient Treatments / Inpatient Treatments etc.) through the web / mobile platform or relationship manager or call centre. Medeaz is not a Medical Practitioner and never offer any medical advice directly. Any service or medical advice provided by the Health providers network is their own opinion and Medeaz cannot be held responsible for accuracy or any discrepancy.
Please note that some of the information that may be available on the Website (including information provided in direct response to your questions or postings) may be provided by individuals in the medical profession. The provision of such Information does not create a licensed medical professional/patient relationship, between Medeaz and you and does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition, but is only provided to assist you with locating appropriate medical care from a qualified practitioner.
It is hereby expressly clarified that, the Information that you obtain or receive from Medeaz, and its employees, contractors, partners, licensors or otherwise on the Website is for informational purposes only. We make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, quality of work, expertise or other information provided on the Website. In no event shall we be liable to you or anyone else for any decision made or action taken by you in reliance on such information.
The Services are not intended to be a substitute for getting in touch with emergency healthcare. If you are an End-User facing a medical emergency (either on your or a another person’s behalf), please contact an ambulance service or hospital directly.
- Your age should be 18 years and above;
- All the personal information and other details you submit to use Medeaz services should be correct and accurate;
- All the services by Medeaz limited for the users exclusively for their personal usage and not for any third party usage or commercial practices.
- You are not eligible to reuse or modify any content, images, logos including but not limited to all copyright and trademark properties of Medeaz unless you have a permission from Medeaz in written to reuse or modify;
- You are not eligible and not permitted to decompile, reverse engineer or disassemble Medeaz;
- You are not eligible and not permitted to access or use Medeaz in any form which may harmful to the Medeaz’s, its partners’, affiliates’ Proprietary Software and Operations;
- You are not eligible and not permitted to upload, submit, write, post, distribute any software computer files which contain any virus or other harmful components or otherwise impair or damage Medeaz, its Partners and Affiliates;
- You expressly understand and agree that to access and/use the Services or Information provided by Medeaz on an “as is” and “as available” basis only. Medeaz, its partners, affiliates, agents, employees, and all other associates disclaim all warranties of any kind, either express or implied, including but not limited to, implied warranties on merchantability, fitness for a particular purpose and non-infringement.
Healthseekers Usage Terms On Subscriptions And Other Services:
My Health Manager Subscriptions:
Relationship Manager: Medeaz will be assigning a relationship manager to each and every subscribed healthseeker family where the family can book their desired healthcare services by contacting the relation manager anytime on the assigned phone number. Despite of ensuring all possible measures to attend all your calls but few situations including but not limited to manager unavailable to take the calls during the telecom network interruptions, or engaged in any other service call, or any other critical situation may not able to answer your calls. You are further requested to contact on our common call centre for any assistance during any such conditions. All the services are available under this facility are exclusively Scheduling of services like Doctor Appointments, Healthchecks, Tests or any schedulable hospital services only. This service is not applicable for any medical emergencies and you are requested to call ambulance or hospital directly.
Discounts: Medeaz has entered into MoUs with all Medeaz Provider partners to extend their services to all Medeaz subscribed healthseekers with possible guaranteed discounts. Despite of ensuring all possible measure of documentation, communication and training measures taken extension of the discounts by our partners are subject to the current conditions or depends on the local governing authorities guidelines only and Medeaz has no liability for any such conditions. You are not eligible for any further claims on this. All the discounts are exclusively available for the subscribed to services users only.
Basic Health Checkup (Know your family health status): The services we offer through this service are accessible from the limited listed healthproviders / clinicians only and subject to the available schedules only.
Primary Health Advice: Medeaz has recruited in-house qualified physicians to serve the healthseekers with primary health advice and basic health education over Telemedicine methods such as Chat or tele-consultation. This service is not intended to be a substitute for any medical treatment and you are further requested to obtain the medical assistance from the Clinics / Hospitals directly.
Scheduling: All types of scheduling are offered by us through all our platforms and are subject to the available slots only and we are not guaranteeing any quality of the service or accuracy in time of services from all our network service providers. You are not eligible for any further claims on this from Medeaz. The information published about the profiles of the doctors and hospitals are solely provided by the provider partners and Medeaz has no liability if any discrepancy in the information provided by any of the provider. Medeaz will positively consider to accept the feedback from you to communicate to the providers in any such observations and will give a chance to the providers to update the accurate information into their profiles and in case if the provider fails to respond to act Medeaz will take necessary action to delist their profiles from Medeaz listings.
Cancellation, Rescheduling & Refund Policy
You are eligible to cancel or reschedule all paid services & schedule only services as described below. In the vent of cancellations the refunds for the paid services shall be subject to the terms & conditions described below:
Cancellations & Rescheduling:
All the booked services for the day will remain cancelled automatically at 12.00 midnight on the same day in the event if the user did not avail the service at scheduled date and time.
Medeaz shall arrange time to time communications to the users if any schedules cancelled by the Healthproviders in the events of unpredictable situations and Medeaz shall allow you to re-schedule the appointment with same facility or any other facility as per your convenience. Medeaz shall either collect the differential amount or refund the same, as the case may be in the event of difference in the charges of the service for rescheduled appointments.
Cancellations by the users are also allowed through relationship manager, mail or call centre for all the bookings until at least 30 minutes before to the time of appointment. In such cases, Medeaz shall initiate immediate refund of your money as per the process defined below.
All cancellations & rescheduling is exclusively available until at least 30 minutes before to the schedule date and time. You are eligible to reschedule any paid or schedule only services during active appointment period only. Medeaz requests you to re-book the appointments in case of unavailed schedules due to any personal reasons.
Medeaz shall initiate refund of the all valid cancellations upon receipt of valid cancellation in the same manner the user paid for the service within 48 hours of time.
Typically, it may take 14(fourteen) working days from the date Medeaz initiates the refund for all refunds processed.
Medeaz shall not be liable for any delays in credit to the cardholder’s credit card account / bank account due to any reasons cited by the account holder’s bank or payment gateway.
You will be provided with refund reference number for further communication with your bank.
No refunds / cancellation requests shall be entertained in case of payment against services delivered fully or partially.
Under no circumstances, cash will be refunded against any cancellation.
Healthseekers Usage Terms On Subscriptions And Other Services:
All the Healthproviders who have desired to list in Medeaz are agreed the following terms and conditions to have partnership with Medeaz:
Partnership & Listing Policy
Medeaz, directly and indirectly, collects information of the Healthproviders (Hospitals’, Clinics’, Institutions, Diagnostics, Pharmacy’s & Practitioners’) like profiles, contact details, and practice schedules. To facilitate the Healthseeker, Medeaz reserves all the rights to take down any Practitioner’s profile as well as the right to display the profile of the Practitioners, with or without notice to the concerned Practitioner. If any information Medeaz has collected and displayed on the Website in connection with you and your profile is found to be incorrect, you are required to inform Medeaz immediately to enable Medeaz to make the necessary amendments. Medeaz shall not be liable for any damage to you linked with the incorrect information displayed on website.
Medeaz has designed the relevance algorithm in the best interest of the healthseekers and may adjust the relevance algorithm from time to time to improve the quality of the results given to the healthseekers. It is a pure merit driven, proprietary algorithm which cannot be altered for specific practitioners. Medeaz shall not be liable for any effect on the Practitioner’s business interests due to the change in the Relevance Algorithm.
Medeaz shall not be liable and responsible for the ranking of the Practitioners on external websites and search engines.
You as a Practitioner hereby represent and warrant that you will use the Services in accordance with applicable law. Any contravention of applicable law as a result of your use of these Services is your sole responsibility, and Medeaz shall not accept any liability for the same.
Confidentiality : The Healthprovider undertakes to maintain in absolute confidence and not to reveal to any person or body, any information or data which it receives through and subsequent for providing the Services pursuant to this agreement and which pertains; directly or indirectly; to the Company or its customers, including the and without derogating from the generality of the aforesaid names, addresses, details and medical background of the Medeaz’s customers, information which pertains to the Medeaz’s business or any other data which is proprietary to the Medeaz and its customers.
Representations And Declarations By The Service Provider
The Health Service Provider declares and undertakes that it has all the necessary registrations/ licenses/ approvals/ authorizations required by the law in order to provide the medical services pursuant to this agreement and that it has adequate ability, knowledge, experience and equipment’s required in order to provide the said service as required in this agreement.
The Healthprovider undertakes to uphold all of the requirements of the law as applicable to it from time to time and shall keep updated the Company, in case of any significant change in the present status of the Provider. The Healthprovider also undertakes that it shall provide the said services in accordance with the provisions of the law and the regulations, which are enacted, from time to time, by the central or the state government or the local administration/ bodies.
The Health Provider has and will continue to have its facilities covered by proper indemnity policy, including error, omission and professional indemnity and agrees to keep such policies in force during the currency of this Agreement.
It has been duly constituted under the applicable laws and has complied with and shall continue to comply with the applicable laws.
Intellectual Property Rights: The parties hereby acknowledge that each party is the legal and beneficial owner of and has exclusive right, title and interest over its own Intellectual property and all other proprietary information in relation to its business. Nothing in this Agreement shall be deemed in any way to constitute a transfer or assignment of any Intellectual property by either party. It is further agreed and understood between the parties that the data and information of users/customers produced through this agreement shall jointly owned by the Health provider and the company.
Governing Law; Dispute Resolution: This Agreement shall be governed by, and construed in accordance with the laws of India, without regard to the principles of conflict of laws of any other jurisdiction. The courts of Hyderabad, India shall havethe exclusive jurisdiction, for remedies available at law to such party.
This is to confirm that we have understood the contents of Medeaz’s Terms and Conditions for Health Provider and the same has been explained and understood by us. We agree and undertake that in performance of our obligations under this agreement with Medeaz, we shall including but not limited to our officers, directors, employees, agents, consultants or representatives, etc., shall be required to adhere to the requirements of this acknowledgement.
